Terms & Conditions

1. Introduction
Welcome to Business Academy Online Ltd. These detailed Terms and Conditions (“Terms”) regulate your access to and use of our educational content, services, websites, and related offerings.

By accessing, registering, or placing an order through either Business Academy Online, you accept these Terms, which will be updated periodically to reflect changes in our policies or operational procedures.

2. Scope of Agreement
These terms apply to all services provided by Business Academy Online Ltd, including
online and classroom courses.

3. Terms of Supply
By placing an order through our website, you agree and confirm that:
● You are legally capable of entering into binding contracts.
● You are at least 18 years old.
● You have read and understood the course overview, requirements, additional
fees, and exam arrangements.

4. Price and Payment
The Fees for any of our Learning Packages are as quoted on our website. These prices are in pounds Sterling and exclude VAT.

You agree to pay the fees for the content you purchase and authorise us to charge your debit or credit card or process other means of payment for those fees.

When you make a purchase, you agree not to use an invalid or unauthorised payment method. If your payment method fails and you still get access to the content, you agree to pay us the corresponding fees within 30 days of notification from us. We reserve the right to disable access to any content for which we have not received adequate payment.

Following registration, payment must be made within 30 days from the date of the invoice, or if the booking is made less than 30 days before the course date, payment is required before the course commencement.

If a student opts to pay via the Business Academy Online Ltd payment plan, they must adhere to the agreement set out at the point of enrolment, paying the instalment amount as agreed and received on or before the agreed date.

It is the student’s responsibility to ensure payments are received on time. Any amendments to payment details or schedules require a 7-day notice period.

Business Academy Online Ltd reserves the right to charge an administration fee for amending or making changes to examinations once booked, unless we have made a booking error.

If there is any change to your exam/membership fee due to a potential price increase by CIPS, there may be additional charges to you.

5. All Inclusive Package
If you book an all-inclusive package, all exam and membership fees paid must be booked and used within 12 months.

Exam Fees shall not be payable on a per-examination or individual basis, but rather as a single, upfront payment covering all applicable costs for the agreed term.

All exam and membership fees paid by you must be utilised within twelve (12) months from the date of payment.

Any unused portion of the Fees remaining after the twelve (12) month period shall be forfeited, and no refunds, credits, or reimbursements shall be due or provided to the Client under any circumstances.

You acknowledge and agree that once the Fees are paid, they are non-refundable, regardless of your decision to participate, complete, or withdraw from any examinations or membership benefits.

In cases where the inability to utilise the Fees within the 12-month period arises due to force majeure events as defined under Clause 12 of this Agreement, the Parties may mutually agree to extend the validity period of the Fees on a discretionary basis.

6. Late Payments
Any late payment will result in an immediate course suspension. Students will be notified and given 5 working days to rectify the outstanding balance. Failure to do so within the 5 working days will result in the full outstanding balance becoming immediately due.

Failure to settle the outstanding balance within 90 working days will result in the full cancellation of your course, without a refund of previous payments. We may pursue legal action if necessary.

7. Courses funded by Third Parties
When a course is paid for by a third party (e.g., a student’s company), we can discuss the account with the third party, including the financial status, delivery status, and any service issues.

If requested, we can update the third party on the student’s progress, including assignments submitted and grades achieved.

8. The Agreement and Order Process

By enrolling in a course or purchasing content, you are getting a license from Business Academy Online Ltd to view the content via our learning platform and other training services.

This license does not give you any right to resell, distribute, share, or transfer the content to others in any manner (including by sharing account information with others or illegally downloading the content and sharing it on torrent sites).

We grant 24 months access license to our students upon enrolment, but we reserve the right to revoke this license if necessary due to legal or policy reasons.

Upon purchasing an order directly online, you will receive an email acknowledging receipt of your order. This does not mean your order has been accepted. The order constitutes an offer by you to us to buy a learning package. All orders are subject to acceptance by us, which we will confirm by sending you a confirmation email. The contract will only be formed when you receive the confirmation.

Booking courses via an online registration form will result in a formal booking confirmation and acceptance on the course.

The contract will relate only to the learning package for which we have confirmed acceptance.

9. Intellectual property
You may not share, reproduce, distribute, or publicly display any course videos, materials, or resources without our prior written consent. This includes unauthorised copying or distribution in any form, including posting on the internet.

All materials provided during the Programme, including but not limited to presentations, videos, and course documents, are the intellectual property of Business Academy Online Ltd.

Participants may not reproduce, distribute, or share these materials without prior written consent.

Violation of this provision may result in immediate termination of your access to our services, legal action for infringement, and compensation for damages.

10. Tutor Selection and Training
Our tutors are selected based on rigorous criteria including professional expertise, teaching experience, and alignment with our educational standards.

Tutors undergo regular performance reviews and training sessions to maintain high-quality instruction and to stay updated with the latest educational practices and standards.

11. Exam Booking and Responsibility
For services including exam bookings, you must actively cooperate by responding to our communications, completing necessary forms accurately, and confirming your exam details on the CIPS dashboard well in advance of the exam date.

It is your responsibility to ensure all exam information is correct and to notify us promptly of any discrepancies or changes needed.

12. Access to Tutors
Reasonable access to tutors is provided as part of your course enrollment. You can expect responses to queries within 2 working days under normal circumstances.

Working hours for response are Monday – Thursday 9am – 6pm GMT. This timeframe may be extended during
holidays or high-demand periods, about which we will inform you.

13. Cancellation, Deferral, and Refunds
If a course is cancelled, delegates will be offered an alternative means of study or date for the same course, or a credit towards another course.

We operate a ‘No Refund’ policy once the registration form has been completed and submitted. Under extenuating circumstances, we may consider postponing the start date to the next available intake, but payment will still be expected from the original start date.

We may also consider transferring the place to another student within the same organisation, but payment will need to be made based on the initial registration form.

Deferral requests must be submitted in writing and will be considered based on criteria such as medical emergencies or significant personal issues, subject to possible administrative fees.

14. Complaints Procedure
We are committed to providing a high standard of customer care. If you are not happy with any element of the service you have received, please contact 0121 838 5437 and speak to our team or email info@businessacademy-online.com

We aim to resolve complaints within 10 working days of receipt, providing you with regular updates. Complex issues may require additional time, but we will keep you informed of the status and expected resolution timeline.

15. Force Majeure
Business Academy Online Ltd shall not be held liable for delays or cancellations due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or pandemics.

16. Changes to Terms
We reserve the right to update these terms at any time. Any changes will be posted on our website, and it is your responsibility to review these terms periodically.

17. Severability

If any provision of these terms is found to be unenforceable, the remaining terms will remain in full force and effect.

18. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of England, and you irrevocably submit to the exclusive jurisdiction of the courts of England.

19. Data Protection
Business Academy Online Ltd will collect, store, and process personal information in accordance with applicable data protection laws, including the UK General Data Protection
Regulation (UK GDPR).
